JakartaBicara, Singkawang Kalbar – Pengadilan Agama Singkawang bersama Kementerian Agama Kota Singkawang serta Dinas Kependudukan dan Pencatatan Sipil Kota Singkawang melaksanakan Pelayanan Terpadu dalam rangka sidang isbat nikah, penerbitan buku nikah dan perubahan status kependudukan yang di bertempat di Aula Kantor Kelurahan Sedau Kecamatan Singkawang Selatan Kota Singkawang Rabu, (29/06/2022).
Humas Pengadilan Agama Singkawang Ahmad Ma’ruf Maghfur, S.H.I., mengatakan bahwa kegiatan ini merupakan bentuk pelayanan dari Pengadilan Agama Singkawang yang pelaksanaannya di luar gedung yakni para pihak datang ke Aula Kantor Kelurahan Sedau, tidak perlu datang ke Kantor Pengadilan Agama Singkawang.
“Bahwa dasar Sidang Isbat tersebut adalah Peraturan Mahkamah Agung R.I Nomor 1 tahun 2015 tentang pelayanan terpadu sidang keliling Pengadilan Negeri, Pengadilan Agama dan Mahkamah Syari’ah dalam rangka penerbitan akta perkawinan, buku nikah dan akta kelahiran dan kegiatan tersebut sangat positif karena mempunyai manfaat yang sangat besar sekali bagi masyarakat, terutama untuk legalitas formal bagi masyarakat yang pernikahannya belum tercatat (nikah siri) karena terkait dengan adminitrasi kependudukan, pengurusan kartu keluarga, akta kelahiran anak-anaknya dan itu semua dibutuhkan buku nikah yang sah secara hukum Islam dan Undang-Undang Perkawinan (UU No. 1 Tahun 1974). Setelah pernikahannya yang dilaksanakan secara sah ditetapkan oleh Hakim, maka para pemohon Isbat Nikah diberikan Buku Nikah, Kartu Keluarga sekaligus Akta Kelahiran anak-anaknya,”ucapnya.
“Humas Pengadilan Agama Singkawang juga mengatakan bahwa pelayanan ini diperuntukkan bagi masyarakat yang kurang mampu dan terkendala masalah geografis dengan tetap memenuhi syarat-syarat yang ditetapkan oleh Pengadilan Agama Singkawang,” ucapnya.
“Ada 20 (dua puluh) peserta yang mengikuti sidang isbat, semuanya berasal dari Kelurahan Sedau. Pada sidang isbat ini, Hakim tidak serta merta mengabulkan begitu saja melainkan memeriksa secara teliti dan detail saat pernikahan para pihak di masa dahulu, syarat dan rukun dalam pernikahan harus terpenuhi di antaranya beragama Islam, bukan mahram, asal wali yang jelas, tidak sedang haji, tidak ada paksaan, adanya calon mempelai, saksi-saksi, adanya wali, serta adanya ijab dan kabul,” ungkapnya.
Semoga pelayanan ini dapat memberikan manfaat khususnya bagi peserta isbat dan kedepannya Pemerintah Kota Singkawang dapat mengakomodir dalam pelaksanaan isbat berikutnya agar masyarakat tertib administrasi dan hak-hak keperdataannya terpenuhi,” tutup Humas Pengadilan Agama Singkawang.
